Terms of Service

These Terms of Service (“Terms”) govern your use of the Everly website at myeverly.ai (the “Site”) and the Everly waitlist. By using the Site or joining the waitlist, you agree to these Terms. If you don’t agree, please don’t use the Site.
The Everly app is still in development. When it launches, it will have its own terms, which you will be asked to accept before using it. These Terms cover the Site and waitlist only.
1. Who can use the Site
You must be at least 18 years old to join the waitlist or contact us through the Site. By doing so, you confirm that you are 18 or older and that the information you provide is accurate.
2. The waitlist and early access
Joining the waitlist lets us contact you about Everly. It does not guarantee access to the app, a place in line, a launch date, or any particular features or pricing. We may offer early access in stages, at our discretion. You can leave the waitlist at any time by unsubscribing or emailing hello@myeverly.ai.
3. Product descriptions and examples
The Site describes features that are still being built. Examples, screens, figures and scenarios shown on the Site, including sample savings, schedules, prices and points, are illustrations of how Everly is designed to work. They are not promises of specific results. Features, availability and design may change before and after launch.
4. Rewards
The Site describes a planned Everly rewards program. Rewards are not available through the Site. If and when the program launches, it will be governed by separate rewards terms. Points will have no cash value unless those terms say otherwise. We may change, suspend or end the planned program at any time before launch.
5. Acceptable use
When using the Site, you agree not to:
- Submit false information, someone else’s email address, or spam through our forms.
- Interfere with or disrupt the Site, or try to gain unauthorized access to it or the systems behind it.
- Use bots, scrapers or other automated means to submit forms or collect information from the Site in a way that burdens it. This does not restrict search engines and AI services that follow our robots.txt file.
- Use the Site for anything unlawful or harmful.
6. Our content
The Site and its content, including text, graphics, logos, animations, video and design, belong to Everly or its licensors and are protected by intellectual property laws. You may view and share the Site for personal, non-commercial purposes. You may not copy, modify, sell or create derivative works from it without our written permission. “Everly” and the Everly logo are our trademarks.
7. Your feedback
If you send us ideas, suggestions or feedback, you agree we may use them to improve Everly without any obligation to you.
8. Privacy
Our Privacy Policy explains how we handle information collected through the Site. By using the Site, you acknowledge that policy.
9. Third-party services and links
The Site relies on third-party services, such as hosting, analytics and fonts, and may link to other websites. We are not responsible for third-party websites or services, and your use of them is governed by their own terms.
10. Disclaimers
The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure. Nothing on the Site is financial, medical, legal or other professional advice.
11. Limitation of liability
To the fullest extent permitted by law, Everly will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Site or waitlist. Our total liability for any claim relating to the Site or waitlist will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, so they may not fully apply to you.
12. Indemnification
You agree to defend and hold harmless Everly from claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute relating to the Site or these Terms will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction. Nothing in this section limits rights you have under the consumer protection laws of the state where you live.
14. Changes and termination
We may update these Terms from time to time by posting a new version with a new effective date. Continuing to use the Site after an update means you accept the new Terms. We may change, suspend or discontinue the Site or waitlist, or remove anyone from the waitlist who violates these Terms, at any time.
15. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and Everly about the Site.
